Legal
General Terms and Conditions
The German version is legally binding. This translation is provided for information only.
1. Scope
These General Terms and Conditions apply to all orders placed through the online shop aaliechtli.ch with Aaliechtli AG, Marktgasse 7, 9050 Appenzell, Switzerland (“Aaliechtli”). They apply to consumers and to business customers alike, unless expressly agreed otherwise. Customers’ own terms apply only if Aaliechtli expressly accepts them in writing.
2. Formation of the contract
The products shown in the online shop are not a binding offer. They invite customers to make an offer. By submitting an order at checkout, the customer makes a binding offer to enter into a purchase contract. The contract is formed when Aaliechtli accepts the order by sending an order confirmation by email or when it ships the goods.
3. Product information
Aaliechtli describes its products to the best of its knowledge. Images, especially of minerals and natural materials, may differ slightly from the piece you receive, because colours and shapes vary naturally.
The descriptions of minerals, healing stones and incense in this shop reflect tradition. They are not a substitute for medical advice. They are neither a promise of healing nor a warranted property within the meaning of Art. 197 of the Swiss Code of Obligations (CO).
4. Prices
All prices are in Swiss francs (CHF) and include statutory VAT (VAT no. CHE-109.617.609 MWST). Aaliechtli shows shipping costs separately in accordance with section 6.
5. Payment
Payment is processed by the payment provider Stripe. You can pay by credit card and TWINT, among other methods shown at checkout. Once you complete payment in Stripe Checkout, the order counts as paid. Aaliechtli ships the goods only after it has received payment.
6. Delivery and shipping costs
Aaliechtli delivers within Switzerland on the following terms:
- a) Standard shipping: CHF 8.50
- b) A-Post (priority mail): CHF 10.50
- c) For orders of CHF 50.– or more, Aaliechtli delivers within Switzerland free of charge.
Delivery abroad is possible on request. Aaliechtli will tell you the shipping costs for your order.
Orders usually leave the shop within a few working days of receipt of payment. If an item is not immediately available, Aaliechtli will tell the customer the expected delivery time.
7. Retention of title
The delivered goods remain the property of Aaliechtli until paid in full (Art. 715 of the Swiss Civil Code, CC).
8. Warranty
The statutory provisions on warranty for defects apply (Art. 197 et seq. CO). The statutory limitation period for warranty claims is two years from delivery of the goods (Art. 210 CO). Customers must inspect the goods promptly after receipt and report any defects without delay (Art. 201 CO), in writing or by email to welcome@aaliechtli.ch.
9. No statutory right of withdrawal
Unlike European Union law, Swiss law does not give a general statutory right of withdrawal for distance contracts. A contract formed under section 2 is binding on both parties.
The statutory rule applies: there is no general right of return or withdrawal. As a goodwill gesture, Aaliechtli may accept returns or exchanges by prior agreement. The goods must be unused and in their original packaging, and the customer bears the cost of return shipping. Opened or used incense and fragrance products (for hygiene reasons) and made-to-order or customised one-of-a-kind pieces are excluded from goodwill returns.
10. Liability
Aaliechtli is fully liable for damage caused by intent or gross negligence, and for personal injury under Art. 100 para. 1 CO. To the extent permitted by law, Aaliechtli excludes liability for slight negligence. It also excludes liability for indirect and consequential damage, in particular loss of profit.
11. Data protection
The processing of personal data in connection with an order is governed by Aaliechtli’s privacy policy, available at aaliechtli.ch/en/datenschutz.
12. Changes to these terms
Aaliechtli may change these terms at any time with effect for the future. The version published on aaliechtli.ch at the time the contract is formed applies.
13. Governing law and jurisdiction
Swiss law applies, excluding the Vienna Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the place of jurisdiction is Appenzell. Mandatory statutory places of jurisdiction, in particular those in favour of consumers, remain reserved.
